Redacting SSN

Client files a chapter 13. Pay day lender files a POC which includes a
copy of the debtor’s check. On the check are the debtor’s SSN,
telephone number and account number. The check is for $350.00. file motion to restrict public access and is sustained. Court
order 15 days to file a new POC with information redacted. Before the
15 days expire payday lender files amended POC which redacts the account number but not the SSN. One thing the creditor might argue is that the Debtor implicitly waived having her SSN publicized by including it on her checks. That doesn’t defeat the fact the creditor is liable, but it could mitigate any damages a judge might award.
