I filed a 13 for a client that was dismissed, then filed a 7 for him within a year. He had worked out arrangements with his secured creditor and so I wasn’t worried about extending the automatic stay. The 7 is still pending and discharge hasn’t been entered yet because we are still within the objection to discharge period.
Today he gets served with a lawsuit on a credit card that was listed in the petition. A few weeks ago, he got a letter from these attorneys about the debt, he called them and told them he had filed bankruptcy and gave them my name and number. But they still filed the lawsuit. If the stay expired before they filed, they are free to waste time and
money filing suit. The discharge will end it. But I’d file an answer
so that they don’t get a public record judgment showing on credit
reports and land records that has to be dealt wiith.
