    Hello,

I had a ch 13 dismissed in March. I worked in Austin but have a house facing foreclosure in Johnson County. I had numerous communication issues with my attorneys office:

    1) I drove to a BK meeting in Ft. Worth only to find it had been cancelled by the court yet the atty’s office confirmed it that morning via phone.
    2) I provided my attorney documentation in order for him to negotiate with my mortgage company and he did not follow up with them.
    3) I repeatedly had difficulty maintaining timely communication with my attorney
    4) I gave my attorney the info to contact the attorneys handling the foreclosure. he did not and the foreclosure occured but was reversed. I am sure that I incurred more fees for this and my electricity was turned off by the realtor that was assigned the property by Fannie Mae. This was in January on a weekend when I had my children and had to spend the weekend in a hotel because it 20 degrees outside.
    5) I asked that my attorney negotiate with the mortgage company to facilitate a loan revision/modification which never happened. I have submitted the necessary forms to them 4 separate times and each time they (Indy Mac) never follow up on it and tell me to resubmit my info. I know that under Fannie Mae guidelines I have the right to this alternative but they never follow through with it.
    6) I finally stopped paying on the BK because I kept hearing from the woman in the trustees office that my plan was not meeting the parameters to avoid being denied and the BK was not facilitating what I needed to happen.

I have a foreclosure sale date of June 1.

I want to keep the house because I have some serious equity in it but, want to work with another attorney.

can you help me and what are your fees to re-start the Ch. 13 process ?

    thank you,
    Doug
